The jammu and Kashmir Right to information act 2009 and Jammu and Kashmir Public Service Guarantee Act 2011,comprises statutory laws which guarantee time bond delivery of services for public services rendered by the Goverment to citizen and provides mechanism for punishing the errant public servant who is deficient in providing the service stipulated under statute.Jammu and Kashmir Right to information act 2009 and Jammu and Kashmir Public Service Guarantee Act 2011,are meant to reduce corruption among goverment officials and to increase transparency and public accountability.
The Jammu and Kashmir Right to Information act 2009,came into force on march 2009,repealing and replacing the erstwhile Jammu and Kashmir RTI act 2004 and the Jammu and Kashmir RTI Amendment act 2008.The act is based closely upon the central RTI act 2005 like all RTI legislation,it is intended to provide citizens a legally mandate mechanism for government records.Central RTI act 2005 which was partially intended to supersede the various state level acts.Furthermore the Central RTI act 2005 enshrines stronger provisions than those seen in the individual state level acts.As such the Central RTI act 2005 applies to the Union Government of India and all of its states and Union territories but not to the State of Jammu and Kashmir.Jammu and Kashmir is accorded special provisions under article 370 of the constitution of India Details of Fee and costs. The Jammu and Kashmirt Public Service Guarantee Act 2011 has come into effect from August 2011.Under the actnany eligible person can file application with the designated officers for providing of notified services within the stipulated time.Under the SRO 224 of the act the following notified offices like Consumer Affairs and PublicmDistribution,Power Development Department,Public Health Engineering,Revenue Department,Transport Department Housing and Urban Development Department Have to dispose any kind of submission pertaining to public service within the stipulated time frame shown in the rules and regulations prescribed in the act.The JKPSGA 2011 provides for imposing fine of Rs 250 to 5000 on such designated officer found responsible for not providing the service to eligible persons within the stipulate time frame or has caused delay in providing the services or has provided service which is deficient in any manner.The act also provides for imposing a fine of Rs 500 to Rs 5000 on first appellate authority for failing to decide the appeal within the stipulated time frame.The act also provides for paying the portion of fine as compensation to the affected eligible person.
